Commercial Agency

The relationship between Principal and Commercial Agent can be complex and uncertain, and we can provide the clarity you need.

Ashby Cohen has extensive experience in dealing with commercial agency issues.

The Commercial Agents (Council Directive) Regulations 1993 provide protection for both the Commercial Agent whose agency may be terminated by the Principal and for the Principal where the Agent, for example, acts in bad faith or is at fault.

The problem often lies in the interpretation. What constitutes 'bad faith'? What happens when an Agent is forced to resign because of a breach committed by the Principal? What happens when parts of the agreement are verbal?

We work with both Agents and Principals to:

  • Protect your position - going into an Agency relationship, we will draft an Agreement to protect your requirements and help avoid future problems.
  • Negotiate - if you are in dispute, we can negotiate a satisfactory solution.
  • Litigate - we offer a full litigation service to help you make or defend a claim.
